In what could be considered another case of a large multi-million dollar company picking on the little guy, Square Enix has announced it has filed a federal lawsuit against several California-based defendants. Square Enix claims that the defendants have infringed on its intellectual property, namely Final Fantasy.
The lawsuit is focused on four wholesale retailers who have allegedly sold unlicensed replica weapons based on several Final Fantasy games. Square Enix is expected to file more lawsuits against additional defendants, stating that that current and future lawsuits are part of its anti-piracy initiatives against individuals and organizations who make unauthorized use of Square Enix’s intellectual properties.
In what could be describe of a misuse of taxpayers money and national security, Square Enix cooperated with the U.S. State Department of Homeland Security and Customs and Border Patrol, agents seized a crate of the unlicensed replica swords.
After an investigation on the company’s part to identify the alleged counterfeiters, Square Enix says those retailers refused to cooperate with them, resulting in the lawsuit.
In a press release issued by Square Enix, general counsel Yasuhiko Hasegawa commented,
“We are actively pursuing those who commit intellectual property infringement against our company. Any illegal activities, including the sale and distribution of unauthorized replica merchandise and counterfeit jewelry, and the unauthorized copying of Square Enix games, music, movies, images, and other intellectual property, will be prosecuted. While Square Enix appreciates the enthusiasm of its fans, and values its relationship with them, it is also obligated to protect its intellectual property rights or risk weakening or losing the very rights that enable the company to continue to provide its fans with an exciting entertainment experience.”
So with these actions taking by Square Enix, it is probably best for fans to not download anymore-illegal copies of Final Fantasy music, images, movies or games, or you might find the US Government at your door with a summons. So be warned.
