The case stems from a 2006 agreement in which MumboJumbo was to produce, distribute and sell certain PopCap games in North America. MumboJumbo alleged that PopCap breached the contract by selling the games on its own. A jury in the 193rd Civil District Court in Dallas County agreed.
The trial took 12 days and key pieces of evidence included PopCap internal emails that the jury believed were an attempt to sabotage the business relationship between MumboJumbo and a major retailer. In addition to the nearly $5 million verdict, there will be a separate hearing to determine the amount of attorneys’ fees that will be added to the damages.
MumboJumbo is a casual game publisher that has studios in Dallas, Texas (USA), and Vladivostok, Russia. Games it has published include Luxor: Quest for the Afterlife and Cake Mania. Those games are available on its website, through game portals and at retailers. PopCap Games is a Seattle-based casual game developer most well-known for the puzzle game Bejeweled.
